Trails of Truth by Pinky Anand and Gauri Goburdhun

Reviewed in India on 20 September 2019

The trials of the most henious crimes that shook the conscience of every Indian to it’s very core. The trials that we wanted to know all about, while we were growing up, pouring over every bit of information we could get our hands on, newspapers, magazines. All of those trials discussed with an utter simplicity so that people from non-legal backgrounds can also comprehend the crazy loopholes, we all lawyers live for. Pinky Anand and Gauri Goburdhun, the mother-daughter duo, creates a perfect series of short stories focusing on the various cases, whose eluding details have long tormented the public. The signifcant portions of the Judgements are quoted in the exact right proportions. The arguments have been diluted to the extent that it can be easily absorbed with a bitter pill of the gruesome details of the cases.
The book focuses on certain legal loopholes in our criminal justice system, on which amendments have been passed recently. It has a  chapter dedicated to Contract Killers and what implications the cases had. Then there is a separate discussion on Indian female criminal minds, like Renuka Shinde and Seema Gavit, the Neeraj Grover murder case, among others. The discussions on the Nithari Kaand, the Nirbhaya Rape Case and  the Tandoor Murder Case is extraordinary and enlightening. It’s a must have for a law student or any legal scholar, and for civilians, this book lifts the veil of mystery cast over our indian criminal justice system.

 in fact in better

Where’s the legal aspect in this? Just a compilation of criminal events over the years. Any mediocre journalist could have written, in fact in better language
Great for non-lawyers and young students

I’ll look at two parameters: (i) the selection of cases, and (ii) their treatment.

Re (i): The book’s title clarifies its scope. I feel the selection of cases is appropriate if the intended audience is general, curious and aware, non-lawyers. Even new law students may benefit from learning about these cases. Insofar as lawyers are considered, not a single one of these cases is even remotely forgotten. In fact, all of these cases find mention a standard law school curriculum. Chintan C. does a good job of balancing the “forgotten”-ness and importance of the cases. Ultimately, the importance facet does come out on top, which is fair in the context of the intended general audience.

I’d note that selection of themes, viz. politics, gender, religion and national security, is excellent.

Re (ii): Not much to add here; Chintan C.’s treatment of cases is fair and accurate. It’s not technical and doctrine-oriented, which is okay… there are other books for that; even better, just read the judgment.

In closing, I think these kinds of books add great value by catering to a general audience. Before enrolling in the law, I used to wish there were these kinds of books that will give an accurate, non-technical primer into important concepts. This book delivers on that front.

 You can’t put it down

I finished this book in a day! The language is lucid and the cases taken up by the author are such that it actually affects our present also. I was heartbroken after reading the Mathura case (how time and again the system has failed women). The segment on politics is equally interesting and apt for present scenario also. The fight for reservation which started in 1951 is still not over. Read how it started.
I recommend this book to all the champions of’ democracy’ and ‘feminism’ to read and of course to ponder on the subject.
I hope the author comes up with more such ‘forgotten’ cases.
